Thymely - Terms of Use
Last updated: 2026-10-30
These Terms of Use (“Terms”) are an agreement between you and NVM LIMITED PARTNERSHIP (NVM EE), Chania 73100, Crete, Greece (“we”, “us”) about Thymely (“the App”). By downloading or using the App, you agree to these Terms. If you do not agree, do not download or use the App.
The App is licensed to you through Apple’s App Store, under Apple’s Licensed Application End User License Agreement (“Apple’s EULA”). These Terms add to Apple’s EULA; where the two conflict, these Terms apply, to the extent the law allows. Our Privacy Policy explains how the App handles information.
1. What the App Is, and What It Is Not
- The App helps you keep track of the food you have, and shows general estimates of how long food keeps.
- The App does not give food safety, medical, health, nutritional or dietary advice. Its shelf-life times are general estimates for food stored properly, based on public sources such as the USDA’s FoodKeeper data. They cannot take into account how a particular food was made, transported, stored or handled, the temperature of your fridge or freezer, or anyone’s health.
- You alone decide whether food is safe to eat. Always check the food itself, and follow the date and storage instructions on the pack, which take precedence over anything the App shows. When in doubt, throw it out.
- Do not rely on the App for food for babies or young children, pregnant people, older people, people with weakened immune systems, or anyone with a food allergy or intolerance.
- Receipts, barcodes and dates on packs are read automatically and can be read wrongly. Product names and details found by barcode come from Open Food Facts, an open database anyone can edit, and can be wrong or out of date. Check everything the App lists, and the food it matches it to.
- Meal ideas are written automatically by Apple Intelligence on your device. They can be wrong, incomplete or unsuitable for you: check every ingredient for allergens, and cook and store food safely.
- Spending, savings and waste figures are estimates from the prices you scan or enter. They are not financial advice or financial records.
- Shopping suggestions, how many to buy and the shopping reminder are estimates from your own history. Check what you need before you buy.
- Reminders depend on your device, its settings and its operating system, and may arrive late or not at all. Do not depend on them.
- A shared kitchen is synced through Apple’s iCloud and depends on it, on your connection and on the devices of the people in it. Changes can arrive late or not at all, and when two people change the same food at the same time, one change can replace the other. Anyone in a shared kitchen can change or delete its food for everyone. Sharing is not a backup.
2. License and Use
- We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, as Apple’s Usage Rules allow, for keeping track of your own food.
- You must be old enough to agree to these Terms where you live, or use the App with the permission of a parent or guardian.
- You may not copy, modify, reverse engineer, decompile or redistribute the App, or use it unlawfully, except as the law expressly permits.
- We and our licensors own the App and its content. These Terms give you no rights in it other than the license above.
3. Premium, Subscriptions and Purchases
- The App is free to use with 3 receipt scans a calendar month. Thymely Premium adds unlimited scans, reading dates off packs, meal ideas, sharing your kitchen, shopping advice (how many to buy, what you often throw away, and a reminder before you shop), and money insights: every week, month and year of groceries, what you’ve saved and what a year of waste costs. Joining a kitchen someone else shares with you does not need Premium.
- Premium is available as an auto-renewable subscription (monthly or yearly) or as a one-time Lifetime purchase. Prices are shown in the App before you buy.
- Payment is charged to your Apple Account when you confirm the purchase. A subscription renews automatically for the same period and price unless it is cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
- Where a free trial is offered, it is charged at the end of the trial unless you cancel at least 24 hours before the trial ends. Any unused part of a free trial ends when you buy a subscription.
- You can manage or cancel subscriptions in your device’s Settings under your name → Subscriptions. Cancelling stops future renewals; access continues until the end of the paid period.
- Apple sells and processes all purchases under its own terms, and handles refunds and any legal right to withdraw from a purchase.
- “Lifetime” means for as long as we offer the App and it works on your devices and operating system. We may change, add or remove features, including Premium features, for valid reasons such as legal requirements, security, or changes to Apple’s or other third parties’ services, and we may stop offering the App. Where the law gives you rights if a paid feature changes, those rights are not affected.
- The App shows no ads.
4. Third-Party Services
The App uses services we do not control, including Apple’s App Store, iCloud, text recognition and Apple Intelligence, and Open Food Facts. Their own terms apply to them, and we are not responsible for their content, availability or accuracy.
5. Your Responsibilities
- Check the food the App lists and the dates it shows, and correct anything it got wrong.
- Keep your device secure. Your data is stored on your device and, if you share your kitchen, in iCloud: we have no copy of it and cannot recover it if it is lost.
- If you share your kitchen, invite only people you trust. They can see, change and delete everything in it, including your history and what you spent, and they keep a copy of its food when they leave or you stop sharing. You are responsible for whom you invite and for what you put in a shared kitchen, and everyone in it is responsible for their own changes.
6. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE APP AND ALL INFORMATION IN IT ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, QUIET ENJOYMENT AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANY SHELF-LIFE ESTIMATE, DATE, PRODUCT DETAIL, MEAL IDEA, SHOPPING SUGGESTION OR MONEY FIGURE IS ACCURATE OR COMPLETE, THAT ANY FOOD IS SAFE TO EAT, THAT REMINDERS WILL BE DELIVERED, THAT A SHARED KITCHEN WILL SYNC, OR THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE OR FREE OF DATA LOSS.
7. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW:
- WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA OR GOODWILL;
- WE ARE NOT LIABLE FOR ANY ILLNESS, INJURY, LOSS OR DAMAGE ARISING FROM EATING, NOT EATING, STORING, FREEZING OR THROWING AWAY FOOD, OR FROM RELYING ON ANY ESTIMATE, DATE, PRODUCT DETAIL, MEAL IDEA, SHOPPING SUGGESTION, MONEY FIGURE OR REMINDER IN THE APP;
- WE ARE NOT LIABLE FOR WHAT OTHER PEOPLE IN A SHARED KITCHEN DO, OR FOR ANY CHANGE, DELETION, DELAY OR LOSS OF DATA THAT COMES FROM SHARING OR SYNCING IT, OR FROM APPLE’S ICLOUD;
- OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE APP OR THESE TERMS IS LIMITED TO THE AMOUNT YOU PAID FOR PREMIUM IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR 10 EUROS (OR THE EQUIVALENT IN YOUR CURRENCY) IF YOU PAID NOTHING;
- THESE LIMITS APPLY WHATEVER THE LEGAL BASIS OF THE CLAIM, INCLUDING CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, EVEN IF WE WERE TOLD SUCH DAMAGE WAS POSSIBLE, AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
8. Rights the Law Does Not Let Us Limit
Some countries, states and provinces do not allow certain warranties to be excluded or certain liability to be limited. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, for gross negligence or wilful misconduct, or under product liability laws, where the law does not allow it to be excluded or limited, or any rights you have as a consumer that cannot be waived by agreement, such as the statutory guarantees in the European Union and the United Kingdom, or under the Australian Consumer Law. Where such laws apply, the exclusions and limits in these Terms apply only to the extent those laws allow.
9. Indemnification
To the extent the law allows, you agree to indemnify and hold harmless us and our partners from claims, losses and costs arising from your breach of these Terms or your misuse of the App.
10. Termination
Your license ends automatically if you breach these Terms. You may stop using the App at any time by deleting it. Sections 1 and 6 to 15 continue to apply after your license ends.
11. Changes to These Terms
We may update these Terms, for example to reflect changes to the App or the law. The “Last updated” date shows the latest revision, and we will give notice on this page before significant changes take effect. If you keep using the App after a change takes effect, you accept the revised Terms; if you do not accept them, stop using the App.
12. Governing Law and Disputes
These Terms, and any dispute about them or the App, are governed by the laws of Greece, without regard to conflict-of-law rules, and the courts of Chania, Greece, have exclusive jurisdiction. If you are a consumer, you keep the protection of the mandatory laws of the country where you live, and you may also bring a claim in the courts where you live if those laws give you that right. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
13. Apple
- These Terms are between you and us, not Apple. We, not Apple, are solely responsible for the App and its content.
- Apple has no obligation to provide any maintenance or support for the App.
- If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, for the App. To the maximum extent permitted by law, Apple has no other warranty obligation for the App.
- Apple is not responsible for addressing any claims by you or any third party relating to the App or your possession or use of it, including product liability claims, claims that the App fails to conform to any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- If a third party claims that the App or your possession or use of it infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement and discharge of that claim.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, may enforce them against you.
14. General
- If any part of these Terms is found unenforceable, it applies to the greatest extent allowed, and the rest of these Terms stays in effect.
- If we do not enforce a part of these Terms, we do not waive our right to enforce it later.
- You may not transfer your rights under these Terms. We may transfer ours to a successor to the App, without reducing your rights.
- These Terms, Apple’s EULA and our Privacy Policy are the whole agreement between you and us about the App.
- These Terms may be translated. If a translation conflicts with this English version, the English version applies, unless the law where you live requires otherwise.
